For purposes of this Privacy Policy, “Personal Information” means any information from or about a person that either identifies that person directly or that makes that person identifiable when it is combined with other information from or about that person from any source.
When you use the Services or otherwise communicate with us, we collect information that you provide to us directly. For example, we collect information in the following circumstances: you (i) use or visit the Site, (ii) register for the Services or create an account or profile or accept the creation of an account or profile on your behalf (an “Account”); (iii) access the Services through third party services; (iv) request technical support; (v) otherwise use Services where Personal Information is required for such use and/or participation; and (vi) when you contact us via the Site or when you otherwise communicate with us. You can choose not to provide information that is requested of you by us; however, this may limit your ability to use or access the Services.
The information you provide to us directly may include, without limitation, the following information that may, alone or in combination with other data, constitute Personal Information:

Additionally, if another user refers you to us by providing us with your e-mail address, we may send you a message. However, we will use your e-mail address only to send such other user’s message unless you otherwise affirmatively provide your information to us.
Most of the data we collect in and through the Site and the Services is technical in nature and is collected and processed automatically through so-called application programming interfaces (“APIs”), software development kits, cookies and similar software-based technologies. Alone or in combination with other data, such automatically collected data may constitute Personal Information. The data we may collect by automated means may include, without limitation:
We may use, depending on the Services, (i) location based on the IP address presented by you, (ii) network-based geo-location data based on proximity of network towers or the location of Wi-Fi networks, and/or (iii) geo-location data based on coordinates obtained from a mobile device’s GPS radio and location services. Your GPS geo-location is accessed in accordance with your device settings. If location services are enabled on your mobile device and/or a mobile application in connection with the Services, certain of the Services will passively and automatically send location information to Nuvo in order for us to deliver location-specific information on your device and compile your individualized timeline. Please note that disabling location service will not anonymize data already collected and uploaded to our servers.
Google Analytics is an element of the Site. By using cookies, Google Analytics collects and stores data such as time of visit, pages visited, time spent on each page of the Site, the Internet Protocol address, and the type of operating system used in the devices used to access the Site. By using a browser plugin available at http://www.google.com/ads/preferences/plugin/ provided by Google, you can opt out of Google Analytics.
The Services may provide the ability to share and access Shared Content and other Account information about you or your Applicants. Information that you provide through the use of these tools will be available to the other users and customers of Nuvo generally. Nuvo has no obligation to keep private any information that you disclose to other users using these functions. You should exercise caution when deciding to disclose Personal Information through the use of these tools or functions.
The Services may include links to third party websites and services where you will be able to post comments or other information. Your use of these third party websites and services may result in the collection or sharing of information about you by these third party websites and services. We encourage you to review the privacy policies and settings on the third party websites and services with which you interact to make sure you understand the information that may be collected, used, and shared by those third party websites and services.
Some of the features on the Site and the Services require the use of “cookies” - small text files that are stored on your device’s hard drive. We use cookies to measure which pages are being accessed, and which features are most frequently used. This enables us to continuously improve the Site to meet the needs of our visitors.

We and our service providers may also use “pixel tags,” “web beacons,” “clear GIFs,” or similar means in connection with the Services and HTML-formatted email messages to, among other things, track the actions of users, to determine the success of marketing campaigns and to compile aggregate statistics about Site usage and response rates.
We collect Personal Information from the following categories of sources: (i) directly from you or our business customers, including through your use of the Services, our Site, and your communications with us; (ii) from the businesses that have engaged Nuvo, including their employees, agents, customers, suppliers, applicants, and trade references; (iii) from publicly available sources, including business registries, government filings, and public websites; (iv) from third-party data providers, including credit bureaus, financial data providers, identity verification and KYC providers, and trade reference databases; and (v) automatically through your interaction with the Services, including through cookies and other technologies described in this Privacy Policy.
We may aggregate, deidentify, or anonymize Personal Information so that it no longer reasonably identifies you or any individual, and we may use, retain, and share such aggregated or deidentified information for any lawful business purpose, including to analyze and improve the Services, develop new products and features, train and evaluate our AI Tools, conduct research, and share insights and statistics with third parties. Certain information may be stored only in aggregated or deidentified form, including, without limitation, usage analytics, performance and error telemetry, and benchmarking statistics derived from the Services. Where we maintain information in aggregated or deidentified form, we will not attempt to reidentify it except as permitted by applicable law.
We use the information you provide to us for the following purposes: (i) to further our legitimate interests in providing the Services, which may incorporate machine learning, natural language processing, predictive analytics, or other artificial intelligence technologies developed by us and/or our third-party providers and subprocessors (“AI Tools”), including without limitation use of your information as part of prompts and inputs for AI Tools, (ii) to administer your use of the Services and any Accounts you may have with us, (iii) to personalize your experience, (iv) to provide to you Service announcements or inform you of new releases and features, (v) to provide you with further information and offers from us or third parties that we believe you may find useful or interesting, such as newsletters, marketing or promotional materials, (vi) to perform tasks on behalf of and according to instructions of a third party, (vii) to enforce our Terms of Service, (viii) to resolve any disputes between users of the Site or between such users and us, (ix) comply with a legal requirement or process, including, but not limited to, civil and criminal subpoenas, court orders or other compulsory disclosures; (x) to further our legitimate interest in protecting our rights, property, or safety and the rights, property and safety of the Services, our users or the public, and (xi) to contact you to obtain feedback from you regarding the Site and the Services.
In addition to the purposes described above, we use the information collected automatically to (i) to further our legitimate interests in monitoring and analyzing the use of the Services and for the technical administration of the Site, (ii) improve the Site and the Services, (iii) generate and derive useful data and information concerning the interests, characteristics and use behavior of our users, and (iv) verify that users of the Services meet the criteria required to process their requests.
We use AI Tools (as defined in Section 3) to support certain features of the Services, including extracting metadata from submitted documents, summarizing trade references, drafting communications, and analyzing data submitted as part of customer onboarding and credit review. Where AI Tools are used to inform business decisions about you or your business (for example, suggested credit limits or risk indicators), any output is provided to authorized users at our customer for review, and Nuvo does not use AI Tools to make solely automated decisions that produce legal or similarly significant effects concerning you without human involvement.
Where applicable law grants you the right to object to automated decision-making or profiling, to request human review, or to obtain meaningful information about the logic involved in the processing of your Personal Information, you may exercise that right by contacting us at privacy@nuvo.com. We will respond within the time periods required by applicable law.
We may disclose Personal Information you provide to us or that we collect automatically on the Site and in and through the Services with the following categories of third parties: A current list of Nuvo's third-party subprocessors is maintained at https://nuvo.com/subprocessors and may be updated from time to time. Nuvo will provide reasonable notice of material changes to its subprocessors as required by applicable law or by agreement with the applicable customer.
Where you provide us with a mobile telephone number and opt in, Nuvo may send you text (SMS/MMS) messages in connection with the Services, such as one-time passcodes and account-security codes, account and transaction notifications, credit and trade-reference updates, customer-support communications, and other service-related or informational messages you have requested. Message frequency varies and depends on your account activity and the messages you have requested. Message and data rates may apply. You can opt out of text messages at any time by replying STOP to any message, and you can reply HELP or contact us at privacy@nuvo.com for assistance.
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. We do not sell or share mobile opt-in data or consent with any third parties. We may share mobile information only with service providers that help us operate the text-messaging program (for example, our messaging platform provider), solely to deliver messages on our behalf, and as otherwise required by law. Mobile carriers are not liable for delayed or undelivered messages.
We frequently make content or services from other websites available to you from links located on the Site. We may present links in a format that enables us to keep track of whether these links have been followed. This Privacy Policy applies only to the Site and the Services. We do not exercise control over third party services or other websites that provide information, or links from within the Site or the Services. Your interactions with these third party services are governed by the privacy policy of the company providing it. These other sites and services may place their own cookies or other files on your computer’s browser, collect data or solicit Personal Information from you. Other websites and services follow different rules regarding the use or disclosure of the Personal Information that you submit, and the collection and use of such information and access of any third party websites are subject to such third party’s privacy policy. We encourage you to read the privacy policies and other terms of such third parties before using their services.
We understand the importance of privacy and security of Personal Information to our users and have made them a priority. Nuvo uses a variety of industry-standard security technologies and procedures to help protect Personal Information about you from unauthorized access, use, or disclosure and trains Nuvo employees on privacy and security issues. Although we work to protect the security of your account and other data that we hold in our records, please be aware that no method of transmitting data over the internet or storing data is completely secure. We cannot guarantee that unauthorized third parties will never be able to overcome those measures or use your Personal Information for improper purposes.
Some web browsers transmit “do-not-track” signals to websites. Because of differences in how web browsers incorporate and activate this feature, it is not always clear whether users intend for these signals to be transmitted, or whether they even are aware of them. We currently do not take action in response to these signals.
We keep your data on your behalf and for your benefit. You can correct or terminate and delete your Account information by following the instructions on the Services or by e-mail at privacy@nuvo.com, which you may also access for further assistance and questions regarding the Privacy Policy or for a copy of your Account data. If you cancel your Account or request us to delete your information, Nuvo will limit its access to Personal Information to perform what is requested by you and will delete information accessible to Nuvo within 45 days. Notwithstanding the foregoing, Shared Content may not be deleted. In addition, Nuvo will delete your Personal Information subject to, and in accordance with, applicable law, and Nuvo may retain certain Personal Information where required or permitted by applicable law, including, without limitation, to comply with tax, accounting, audit, anti-money-laundering, fraud-prevention, recordkeeping, regulatory, and other legal obligations, to resolve disputes, to enforce our agreements, and to establish, exercise, or defend legal claims.
California Civil Code Section 1798.83 requires certain businesses that share customer Personal Information with third parties for the third parties’ direct marketing purposes to respond to requests from California customers asking about the businesses’ practices related to such information-sharing. We currently do not share or disclose your Personal Information to third parties for the third parties’ direct marketing purposes. If we change our practices in the future, we will implement an opt-out policy as required under California laws.
Regardless of where you are located, we believe in providing all of our users with meaningful control over their Personal Information. Accordingly, we extend the following rights to all users of our Site and Services. These rights reflect our commitment to transparency and user empowerment, and we honor them as described in this Privacy Policy. We may update the scope of these rights from time to time as privacy laws and our practices evolve.

You have the right to request that we delete any Personal Information about you that we have collected. Upon receiving a verified request to delete Personal Information, we will do so unless otherwise required or authorized by law. You may submit a request to delete Personal Information by emailing privacy@nuvo.com.
You have the right to request that we correct inaccurate Personal Information that we maintain about you. Upon receiving a verifiable request, we will use commercially reasonable efforts to correct the inaccuracy, taking into account the nature of the Personal Information and the purposes for which we process it. You may submit a request to correct by emailing privacy@nuvo.com.
For the purposes of this Privacy Policy, 'Sensitive Personal Information,' means government identifiers (such as Social Security numbers and tax identification numbers), financial account numbers and account-access credentials, and precise geolocation. As part of customer onboarding, credit review, identity verification, payment processing, and the operation of the Services, we may collect categories of Sensitive Personal Information including, without limitation, tax identification numbers and tax filings, bank account information, and credit information.
We use Sensitive Personal Information for the following purposes: (a) performing the Services that you or our customer have requested; (b) preventing, detecting, and investigating security incidents; (c) resisting malicious, deceptive, fraudulent, or illegal actions; (d) ensuring the physical safety of natural persons; (e) short-term, transient use; and (f) verifying or maintaining the quality or safety of our Services.
In the preceding 12 months, we have collected the following categories of Personal Information: identifiers; commercial information; internet or other electronic network activity information; geolocation data; professional or employment-related information; and inferences drawn from any of the above. We have also collected Sensitive Personal Information as described above. The categories of sources from which we collect Personal Information are described in the 'Sources of Personal Information' subsection of Section 2.
We retain each category of Personal Information for as long as your or our customer's account remains active, or for the period required by our agreement with the applicable customer. Following deletion or account termination, Personal Information may persist in our database backups for up to thirty (30) days, after which it is rendered irrecoverable. We may retain Personal Information for longer periods where required or permitted by applicable law, including for tax, accounting, audit, anti-money-laundering, fraud-prevention, recordkeeping, regulatory, dispute-resolution, and legal-claims purposes. Retention of cardholder data is further governed by our Data Retention and Disposal Policy, including its PCI DSS addendum.
[While we do not sell your Personal Information in exchange for monetary consideration in the traditional sense, you also have the right to opt out of the “sale or sharing” of your Personal Information, or the use of your Personal Information for targeted advertising purposes.] We honor opt-out preference signals, including the Global Privacy Control ('GPC'), where required by applicable law.
You may designate an authorized agent to make requests on your behalf. You must provide an authorized agent written permission to submit a request on your behalf, and we may require that you verify your identity directly with us. Alternatively, an authorized agent that has been provided power of attorney pursuant to applicable law may submit a request on your behalf. For purposes of this Privacy Policy, an authorized agent must be a natural person, or a business entity that is registered with the California Secretary of State and authorized to do business in California, acting through one or more natural persons. Automated systems, software agents, bots, large language models, and other artificial intelligence agents are not eligible to serve as authorized agents.
You may submit a request for access and requests to delete Personal Information about you by:
Upon receipt of a request, we may ask you for additional information to verify your identity. Any additional information you provide will be used only to verify your identity and not for any other purpose.
We will acknowledge the receipt of your request within 10 days of receipt. Subject to our ability to verify your identity, we will respond to your request within 45 days of receipt. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing. In order to protect your privacy and the security of Personal Information about you, we verify your request and identity.
The response we provide will also explain the reasons we cannot comply with a request, if applicable.
We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.
You have the right not to be discriminated against for the exercise of your privacy rights described above. Unless permitted by applicable law, we will not:
If you are located in the European Economic Area, the United Kingdom, or Switzerland (each, an 'EEA/UK/Swiss Resident'), the following additional provisions apply to your use of the Services.
Controller. Nuvo Technologies, Inc. is the controller of your Personal Information for purposes of the EU General Data Protection Regulation (the 'GDPR') and the UK GDPR (collectively, 'European Data Protection Law').
Legal Bases for Processing. We process your Personal Information on one or more of the following legal bases: (i) the performance of a contract with you or with the customer that has engaged you; (ii) compliance with our legal obligations; (iii) your consent, where we have requested it and you have provided it (which you may withdraw at any time without affecting the lawfulness of processing before withdrawal); and (iv) our legitimate interests in operating, securing, and improving the Services, developing new features (including AI Tools), preventing fraud, and communicating with you, where those interests are not overridden by your rights and interests.
Your Rights. Subject to applicable law, you have the right to: (i) access your Personal Information; (ii) request rectification of inaccurate Personal Information; (iii) request erasure of your Personal Information; (iv) request restriction of processing; (v) request portability of your Personal Information; (vi) object to processing carried out on the basis of our legitimate interests, including for direct marketing; (vii) withdraw your consent at any time where we are processing on the basis of consent; and (viii) lodge a complaint with your local data protection supervisory authority. You may exercise these rights by contacting us at privacy@nuvo.com. We will respond within the timeframes required by European Data Protection Law.
International Transfers. Nuvo is located in the United States, and your Personal Information will be transferred to, and processed in, the United States and other jurisdictions that may not provide the same level of data protection as your country of residence. Where we transfer Personal Information from the EEA, the United Kingdom, or Switzerland to a country that has not received an adequacy decision from the European Commission, the United Kingdom, or the Swiss Federal Data Protection and Information Commissioner (as applicable), we rely on appropriate safeguards, including the European Commission's Standard Contractual Clauses, the UK International Data Transfer Addendum, and the Swiss equivalents, as applicable. A copy of the safeguards we use is available upon request to privacy@nuvo.com.
EU Representative and Data Protection Contact. To the extent required by Article 27 of the GDPR, Nuvo has appointed an EU representative who can be contacted at dpo@nuvo.com. Our privacy contact, including for matters under European Data Protection Law, may be reached at privacy@nuvo.com.
Automated Decision-Making. Please see Section 3A for information about our use of AI Tools and your rights with respect to automated decision-making and profiling.

The Services are intended for use by businesses and their authorized representatives, and are not directed to children under the age of eighteen (18). We do not knowingly collect Personal Information from children under 18. If we become aware that we have collected Personal Information from a child under 18, we will take appropriate steps to delete that information. If you believe a child under 18 has provided Personal Information to us, please contact us at privacy@nuvo.com.
Our security and Privacy Policy are periodically reviewed and enhanced as necessary. This Privacy Policy might change as we update and expand the Services. You can tell when this Privacy Policy was last updated by reviewing the “Last Updated”-legend on top of this page. We will endeavor to notify you of these changes by email, but will not be liable for any failure to do so. We also encourage you to review this Privacy Policy periodically. If you do not understand any of the terms or conditions of any of our policies, you may inquire regarding the same via email at privacy@nuvo.com. Your continued use of the Services after any change in this Privacy Policy will constitute your acceptance of such change.
